5th Amendment Right to remain silent

The variables that are involved in a criminal case are complex and must be addressed with great care and skill.  It is important that you immediately take steps to protect your rights and your liberty.  Your actions and/or inaction could make things worse for yourself and limit your defense strategy options. If you think you might be charged with a crime, you should consult with an attorney BEFORE you speak with anyone else. You may inadvertently make your case worse by speaking with someone else first.

If you have been arrested, you should immediately invoke your 5th amendment right to remain silent and let your request for an attorney be immediately known. If you make no (zero as in none) statements (verbal or written), then the prosecutor will not be able TO USE YOUR OWN WORDS against you in the future.

FYI: If you give consent to the police officer to search you, your car, your house, your luggage at the airport etc… then the Police officer does not need a search warrant. Police officers have been known to flat out lie to you to get your “voluntary” consent to search.  They will often use tactics to intimidate and/or coerce you to give your supposedly “voluntary” consent to search.

You see news reports/videos everyday as to how police officers abuse their position and are themselves arrested.  There are literally thousands of NOT GUILTY verdicts handed out in court every year. Why, think about it for a moment.

Police officers use your lack of knowledge (a polite way to say ignorance) of your legal rights as a weapon against you.  You do not need to make their job easier for them. There are thousands of people every day that know their rights, they do not give consent to search, they do not make ANY statements, they remain silent, they ask for an attorney and as a result will not have their own words or items seized from an “illegal” search used against them.
